Justice for Elizabeth
By Michelle James REGISTER-HERALD [Beckley,
West Virginia] LIFESTYLES
EDITOR, Oct 9, 2015
Saturday evening, the names of 34
people who have lost their lives in domestic violence related homicides in West
Virginia in the past 12 months will be read at the Women’s Resource Center’s
25th Annual Candlelight Vigil.
A 35th name — one long overdue — will
also be read. Elizabeth Spinks’ life was cut tragically short on Oct 31, 2008 [sic--2007],
but it wasn’t until 2014 that her husband, Paul Darren Spinks, was finally
indicted for her murder, and it was not until August that he was convicted.
Elizabeth, a resident of Birch River in
Nicholas County, was just 35 when she was killed by what her husband told
authorities was a sniper’s bullet. West Virginia State Police Cpl. D.P. White
says she suffered a fatal wound to the chest and Spinks, who goes by Darren,
was shot in the leg. Spinks, White said, told authorities the couple had been sitting
on the front porch of their home when they were struck by the sniper’s bullets.
No weapon was ever found and although
White said it quickly became clear Spinks’ story was “implausible,” the case
was difficult to prove.
Kathrine Gregory was 6½ years
younger than her older sister Elizabeth. Raised in Cowen in Webster County by a
single dad, Major Smith, who she calls “ the original
Mr. Mom,” Kathrine, “Kat” to those close to her, says she and “Libby” were
typical sisters.
“We were close most of the time,” she
said. “We would argue with each other, but no would else was allowed to argue
with us.”
Elizabeth was a young mother. She was
just shy of 17 when she had her first child, a girl. She dropped out of high
school and married, had baby boy at 19 and eventually divorced.
Kathrine says her sister later earned
her G.E.D., found love again and became engaged. But she left the relationship
when the engagement didn’t progress to marriage.
“She wanted more,” Kathrine said.
So Elizabeth moved back to her dad’s
house in Cowen and took a job at the Birch River Go-Mart, where she met Darren
Spinks.
“Within two weeks of working there,
Darren was on her, telling her everything she wanted to hear,” Kathrine said,
explaining Darren’s promises to Elizabeth that he would help her gain full
custody of her children and would “fix all her problems.”
“They were married within six weeks.”
Kathrine
said her relationship with Elizabeth quickly changed as Spinks isolated the
sisters within the first three months of the marriage.
“When I tried to call her, he would
immediately answer the phone and not let me talk to her,” she said. “We had landlines
then, so when she did answer, he would pick up the other line and would yell
and scream so she couldn’t hear. He would yell, ‘blah, blah, blah, blah, shut
up, shut up, shut up, shut up.
“And soon after that, he blocked my
number so I couldn’t call at all.”
Kathrine encouraged her sister to leave
the marriage — especially when she saw signs of physical abuse.
“When I would say, ‘You have to leave,’
she would say, ‘I shouldn’t have provoked him,’ or, ‘Maybe that bruise is from
where I fell,’” she said. “It was a hopeless situation on our end.”
Spinks, Kathrine said, soon restricted
Elizabeth’s travels. She was not allowed out alone and she was no longer
allowed contact with her sister.
“When I would see her in public, she
would put her head down like she couldn’t look at me,” Kathrine said. “I would
see her drive by and she would turn her head.”
Elizabeth was, however, allowed contact
with her father, but Kathrine said she never provided him a full look at her
life.
“She would still call him pretty
regular,” she said, “But if she went to his house in Cowen, she wasn’t allowed
to go alone and she was timed.
“And if I showed up, she would say, ‘I
gotta go.’”
But still, Kathrine urged her sister to
leave, asking her to move in with her family, which grew to include two
daughters of her own.
Elizabeth never got the chance.
Kimberly Tyler-Stirling, an advocate
for the Women’s Resource Center’s Nicholas County Office, said Elizabeth’s
passing was “one of those things you remember where you were, what you were
wearing and what you were doing when you were told.”
Tyler-Stirling said Elizabeth had
visited her office for help and had made a couple after-hours calls to the
crisis hotline as well. She said she sat with her during a court hearing — the
last time she saw her alive.
Elizabeth, Tyler-Stirling said, sought
and received a Domestic Violence Petition against Spinks, but then had it
reversed. It was the reversal hearing when she last saw her.
“Ultimately, we can’t take control of
someone’s lives,” she said. “We can’t make somebody do something they’re not
ready to do. What we can say is, ‘If you decide to leave, we will help. There
is somebody to help you.
‘I will help you.’”
Tyler-Stirling says encouraging someone
to leave a domestic violence situation can put his or her life at risk, as the
moment of departure is the most dangerous moment.
“You always need to have a plan in place,”
she said. “Don’t announce you’re leaving. If there’s not an exit plan, it can
be very dangerous.”
Although it wasn’t known at the time of
her death, authorities later came to believe Elizabeth did in fact have a plan
in place.
Shortly after Elizabeth’s murder, Cpl.
White says Spinks sold her vehicle and while the vehicle was being cleaned, a
divorce packet was located.
“That let us know where her mind was,”
Kathrine said. “She was planning. She was trying to wait until it was safe for
her to leave.”
That was part of the evidence that
helped lead to Spinks’ conviction, White said, but ultimately he said it was
the history of domestic violence provided by Elizabeth’s family and daughter
especially, that helped bring Spinks to justice.
“It was very instrumental, I believe,”
he said.
Although it took nearly eight years for
the legal system to catch up to Spinks, White says he’s proud that Elizabeth’s
family finally saw “him get justice.”
Kathrine said she “annoyed” police
regularly, calling them on a daily basis for updates. At each step, she said,
she knew they were working as hard as they could.
“It was never a cold case with us,”
White said. “This was her (Kathrine's) family, her sister, her loved one. We,
as an agency followed through with her because, quite frankly, she motivated
us. She never bugged us …
It helped us as investigators.”
Major Smith, Kat and Libby’s “Mr. Mom”
did not live to see justice for his oldest little girl, as he passed away
shortly before the trial.
"That’s the only regret I have in
this case," White said. "I wish Mr. Smith had been present and had
heard this verdict.”
Kathrine will serve as the keynote
speaker for Saturday’s candlelight vigil.
She says she has learned a lot about domestic violence since Elizabeth
was killed and admits that she probably didn’t know many of the right things to
say to help at the time.
Today, she says, she better understands
that Darren probably punished Elizabeth behind closed doors when she “smarted”
off to him in her defense, and she says telling her to leave without a plan in
place was not the best idea either.
She will share her story with those who
will listen in hopes of saving the life of someone else’s sister.
“I’d hate for another person to go
without,” she said. “It’s like my dad told me, ‘It doesn’t matter how old your
children are. They’re still your babies.”
The candlelight vigil, which is open to
the public, will take place from 5 to 7 p.m. at The Place at the United
Methodist Temple in Beckley.

I-68 Closed After Fatal
Crash, Chemical Spill
MORGANTOWN, W.Va. -- Residents were ordered to stay in
their homes Friday near Cheat Lake, W.Va., after a hazardous chemical spill on Interstate
68 just east of Morgantown. A
shelter-in-place advisory for about 4,000 homes in the Cheat Lake area was
lifted by 3 p.m. but I-68 remained closed.
Mike Wolfe with Monongalia County Emergency Management said the
Department of Environmental Protection determined there is no health threat
from the chemical toluene that leaked from a tractor-trailer. The big rig overturned at about 4 or 4:30
a.m. Friday, killing the driver, 40-year-old Paul Staley, of New Martinsville,
W.Va. It wasn't immediately clear how
much of the chemical spilled from the truck, but Wolfe said the leak had been
contained. Toluene is a colorless liquid
used in the making of paints, paint thinners, fingernail polish and other like
products. Exposure can affect a person's nervous system -- causing dizziness,
nausea, unconsciousness or even death.
